Our training methodology focuses on emotional well-being, relationship building, and creating clear communication between dogs and their owners. All programs are hosted at our premier partner facility, Chucktown Charley, located on Johns Island.

The Website provides information about these services, allows prospective clients to request discovery sessions, and serves as an educational resource for dog owners.

We enjoy sharing valuable content on our Website about dog training and relationship building. However, in making this content publicly available, we still hold ALL of the Intellectual Property Rights to the work. All intellectual property rights including, but not limited to trademarks, copyrighted material, trade secrets, and other proprietary information are owned by the Company and its designees. Dog Training Services Terms

The following terms apply specifically to our dog training services:

1. Facility Rules: When visiting our facility, you agree to follow all posted rules and staff instructions for the safety of all people and animals present.
2. Assessment Process: All training programs begin with an assessment of your dog’s needs and behavior. This assessment is crucial for determining the appropriate training program.
3. Training Programs: Our training programs vary in length, intensity, and focus. Details of each program, including pricing, are available during a discovery session.
4. Owner Participation: All programs require owner participation and training. You agree to participate as required for optimal results.
5. Training Location: Training services are conducted at our Chucktown Charley facility on Johns Island unless otherwise specified. Some programs may include at-home sessions.
6. Results: While we strive for excellence in all our training programs, results may vary based on the individual dog, consistency in following our guidance, and continued practice of training techniques.
7. Dog Safety and Health: You represent that your dog is in good health and has all required vaccinations before participating in any training program. You agree to inform us of any health issues, behavioral concerns, or special needs your dog may have.

Termination

We reserve the right to terminate or suspend your access to the Website and our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

The Company is providing this Website and all content accessible through it on an “As-Is” basis for individual use by you at your own risk and without any warranties, whether express or implied, including, but not limited to warranties of title; merchantability; fitness for a particular use; or any rights or licenses in this Agreement. We cannot guarantee that the Website and any downloadable content will be free from viruses or other harmful code. The Company makes no warranty as to the accuracy and reliability of information set forth on the Website and its content.

You understand and agree that the Company does not guarantee specific results from our training programs. While we employ proven training methodologies and have a track record of success, each dog’s behavior, temperament, and learning style is unique. Training outcomes depend on multiple factors, including owner consistency, the dog’s age, previous experiences, and temperament.

Limitation of Liability

The Company is in no way liable to You or any other third party for any and all damages including, but not limited to, punitive or exemplary damages or those resulting from negligence relating to this Agreement or Your use of this Website, regardless of whether the Purchaser was advised of such damages, the foreseeable nature of the damages, and the legal or equitable theory upon which the claim for damages is based.

With respect to our training services, we are not liable for:

• Injuries to your dog or other animals during training
• Property damage caused by your dog
• Behavior regression if training practices are not maintained
• Injuries to persons caused by your dog’s behavior

If found to be applicable by a court of competent jurisdiction or by law, the Company’s total liability arising out of or related to this Agreement and your use of the Website or services will be limited to the total amount paid to the Company preceding the event giving rise to the claim.

This Limitation of Liability provision does not purport to affect any liability that cannot be excluded or limited under the law.

Governing Law and Dispute Resolution

In the event there is a dispute between the Parties that cannot be brought to an amicable mutual understanding, the Parties understand and agree that such dispute will be handled through binding arbitration in alignment with the rules of the American Arbitration Association. The Parties understand that they will be bound by any decision rendered by the arbitrator and/or arbitration proceedings. The arbitration itself will be held in Charleston County, South Carolina. If the arbitration is unable to move forward in the designated jurisdiction, the Company will unilaterally elect another venue for the arbitration. The Parties will equally share in the costs and expenses of arbitration and any related proceedings.

This Agreement and the Parties’ relationship are governed by the laws of the State of South Carolina. In the event of conflicting laws, the laws of the State of South Carolina will control.

Changes to Terms

We reserve the right to update and revise these Terms at any time without notice to you. The date that these Terms were last updated is noted at the top of this Agreement. Your continued use of the Website after we have updated these Terms indicates your acceptance and agreement to the changes.
